Welcome to SceneIn. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SceneIn Technologies Private Limited ("Company," "we," "us," or "our") regarding your access to and use of the SceneIn mobile application and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, strictly do not use the Service.

1. Eligibility & Account Security

• Age Requirement: You must be at least 18 years of age to register for an account, create events, or purchase tickets on SceneIn.
• Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials (OTP/Password). You agree to accept responsibility for all activities that occur under your account.
• Identity Verification: We reserve the right to request government-issued identification (e.g., PAN, Aadhar) to verify your identity for fraud prevention, especially if you are hosting events or selling tickets.

2. Role of SceneIn (Platform Nature)

SceneIn operates as a technology platform and online marketplace.

• Intermediary Status: We are not an event organizer, promoter, or creator. We provide the technical infrastructure for Users to create events, sell tickets, and resell tickets to one another.
• No Endorsement: We do not control, endorse, or guarantee the quality, safety, or legality of any event listed on the Service.

3. Primary Ticketing (Paid Events)

• Host Responsibilities: If you use the Service to create and sell tickets for an event ("Host"), you are solely responsible for the event's execution, safety, and compliance with local laws. You permit SceneIn to act as your limited commercial agent solely for the purpose of collecting ticket proceeds.
• Ticket Deliverables: Tickets purchased for primary events are delivered digitally within the App.
• Cancellations: If a Host cancels an event, the Host is solely responsible for authorizing refunds. SceneIn is not liable for costs incurred by Buyers due to event cancellations.

4. The Resale Marketplace (Secondary Sales)

• Resale Policy: Users may list purchased tickets for resale on the SceneIn marketplace ("Sellers").
• Fair Value Policy: To prevent price gouging, SceneIn may enforce price caps limiting resale listings to the ticket's original face value or a reasonable percentage above it. We reserve the right to delist tickets that violate fair pricing standards.
• Seller Guarantee: As a Seller, you warrant that the ticket you list is valid, authentic, and has not been sold or transferred elsewhere. Listing invalid or duplicate tickets constitutes fraud and will result in immediate account termination and legal action.
• Buyer Acknowledgement: Buyers acknowledge that resale tickets are sold by third-party users, not SceneIn. While we employ verification technology, we act only as an intermediary facilitator.

5. Payments, Fees & Settlements

• Payment Processing: All payments are processed through third-party payment aggregators (e.g., Razorpay). SceneIn does not store full credit card details.
• Service Fees:
  • Buyers: We charge a non-refundable "Booking Fee" or "Platform Fee" on top of the ticket price to cover secure processing and platform maintenance.
  • Sellers/Hosts: A "Commission Fee" will be deducted from the total ticket sales before the final payout.
• Payouts & Settlements:
  • Earnings for Event Hosts and Resale Sellers are credited to their designated bank accounts via standard banking channels (NEFT/IMPS/UPI).
  • Payouts are subject to standard settlement timelines (typically T+2 to T+5 business days after event completion or successful verification) to ensure transaction security.
  • You are responsible for providing accurate banking details. SceneIn is not responsible for funds transferred to incorrect accounts due to user error.

6. User Conduct & Prohibited Content

You agree strictly NOT to:

• Post content that is illegal, defamatory, fraudulent, or hateful.
• Use the platform for any activity related to gambling, money laundering, or unauthorized commercial solicitation.
• Child Safety (Zero Tolerance): We strictly prohibit any content related to Child Sexual Abuse Material (CSAM). Any violation will be immediately reported to law enforcement authorities (e.g., NCMEC/Cyber Crime India) and your account will be permanently banned.

7. Disclaimers & Limitation of Liability

• "As Is" Service: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
• Event Liability: SceneIn is not liable for any injury, loss, or damage occurring at any event listed on our Service. You attend events entirely at your own risk.
• Marketplace Disclaimer: While we strive to verify tickets, SceneIn disclaims all liability for disputes arising from the resale transaction between Buyer and Seller beyond the value of the transaction processed on our platform.

8. Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or if required by legal authorities.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Deoghar, Jharkhand.
